Terms of Service
Last updated: August 11, 2026
1. Who we are
GuardianAgent (“GuardianAgent,” “we,” “us”) provides self-service document preparation and workflow software for homeowners selling their own property (“FSBO”). By using this website or our tools, you agree to these Terms.
2. Not a law firm, brokerage, or lender
GuardianAgent is not a law firm and does not provide legal advice, legal opinions, or legal representation. We are not a licensed real estate brokerage and do not represent buyers or sellers in a transaction. We are not a title company, escrow agent, appraiser, or lender.
Our software places the information you provide into state-specific forms. It does not tell you whether a term is appropriate for your situation. Only a licensed attorney in your state can advise you on your rights and obligations, and only your title or closing company can determine what it will accept for closing.
3. Your responsibilities
- You are responsible for the accuracy and completeness of every answer you provide.
- You are responsible for reviewing every document before signing or delivering it.
- You are responsible for meeting the dates and deadlines in your contract. Reminders in the app are a convenience, not a guarantee.
- You must be legally able to sell the property and to enter into a binding contract.
4. Fees
Document preparation is a flat $1,500 fee paid by the seller. The listing builder is free to use. Certification as a title-company partner is free under our current program; there is no setup fee, subscription, or partner fee. Any future partner pricing would apply only under a separate written agreement signed by that company. Fees and features may change prospectively, and the price disclosed to you before you pay is the price that applies to your order.
5. Documents and records
Completed contracts and closing documents are held by the title or closing company of record for your transaction. GuardianAgent is not your recordkeeper and does not guarantee ongoing access to completed documents through the app.
6. Third parties
Title companies described as certified GuardianAgent partners are independent businesses. They are not our agents or employees, and we are not responsible for their services, pricing, or closing decisions. Third-party listing platforms such as Zillow or Facebook Marketplace have their own terms; you are responsible for complying with them.
7. No guarantee of outcome
We do not guarantee that your property will sell, that a contract will be enforceable, that a packet will be accepted without changes, or that a closing will occur. The service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, GuardianAgent's total liability arising out of or related to the service will not exceed the amount you paid us for the transaction at issue. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost sale proceeds.
9. Acceptable use
You may not use the service for an unlawful purpose, submit content that violates fair housing laws, misrepresent a property, or attempt to disrupt, reverse engineer, or scrape the service.
10. Changes and termination
We may update these Terms and will post the revised version here with a new date. We may suspend or terminate access for violations of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Arkansas.
